Purchase conditions

General terms and conditions of purchase apply to purchases from Gold Dry. Dutch law applies to all texts, orders and agreements of Gold Dry.

Article 1: General

1.1 In these Purchase Conditions the following terms have the following meanings: “Gold Dry” or “Gold Dry.nl Internet-Shop”: Gold Dry; customer: the (potential) customer of Gold Dry’s goods and / or services; “Confirmation”: the confirmation of receipt, as described in articles 2.2 and 3.1. “Purchase Conditions”: these Purchase Conditions.
1.2 These Purchase Conditions apply to all offers, orders and agreements of Gold Dry. By entering into an agreement between the customer and Gold Dry by means of the procedure as described in these Purchase Conditions, the customer explicitly accepts these conditions.
1.3 All rights and claims, as in these Purchase Conditions, and in any further agreements stipulated on behalf of Gold Dry, are also stipulated on behalf of intermediaries and other third parties engaged by Gold Dry.
1.4 Deviations from these Purchase Conditions are only valid if they have been expressly agreed in writing with Gold Dry.
1.5 If (a) provision (s) of these Purchase Conditions is / are null and void or is / are destroyed, the other provisions of these Purchase Conditions will remain in full force and effect. (and) to agree to replace the void or voided provision (s), taking into account as much as possible the purpose and purport of the void or voided provision (s).
1.6 Gold Dry has the right to change these Purchase Conditions and the content of the Gold Dry website at any time.

Article 2: Offers and agreements

2.1 All offers made on the Gold Dry website are without obligation, even if they contain a term of acceptance. Gold Dry reserves the right to withdraw offers at any time. All offers are subject to availability. Price changes are reserved at all times.
2.2 An agreement between Gold Dry and the customer is concluded after the customer:
has placed an order on the Gold Dry website, by completing the order form on the Gold Dry website correctly and completely;
the customer then clicking on the “Checkout” icon on the Gold Dry website;
hereafter confirming by the customer that the information provided by the customer is correct and to have the customer’s payment processed, by clicking on the “Send order” icon on the Gold Dry website,
has received a confirmation from Gold Dry to the e-mail address of the customer that Gold Dry has received the order from the customer (the confirmation of receipt).
2.3 The agreement contains all agreements made between the customer and Gold Dry and replaces all previously made agreements, arrangements and / or agreements between the customer and Gold Dry.
2.4 The administration of Gold Dry applies, subject to proof to the contrary, as proof of the orders and payments made by the customer to Gold Dry and of deliveries made by Gold Dry. Gold Dry recognizes that electronic communication can serve as evidence. The customer also acknowledges this by accepting the Purchase Conditions.
2.5 The confirmation of receipt will in any case state the following information:
a description of the product purchased by the customer and the number of products purchased by the customer;
the price of the product;
customer data such as name, customer number, home address, address to which the product will be sent, billing address (if different from the customer’s home address and / or delivery address) and the customer’s e-mail address and telephone number;
the order number of the agreement;
the e-mail address and / or telephone number of the department of Gold Dry, where the customer can go with questions about the order.

Article 3: Prices / rates and payment

3.1 All prices for the goods offered are in Euro and include sales tax (VAT) and other levies imposed by the government and exclusive of handling and shipping costs, unless stated otherwise or agreed in writing.
3.2 All invoices will be paid by the customer, without discount or compensation, within fourteen (14) working days after the invoice date, unless otherwise agreed in writing.
3.3 In the event that the payment term is exceeded, Gold Dry is entitled to charge interest of 1% per month to the customer from the due date of the invoice, whereby part of a month is counted as a whole month. Gold Dry will send a reminder if the payment term is exceeded.
3.4 If, even after sending the reminder, the customer has not paid, not fully or not before the payment deadline set in the reminder, Gold Dry has the right to charge its extrajudicial (collection) costs to the customer. . The customer is also obliged to pay actual legal costs, insofar as a possible court costs order ends up at a lower amount.
3.5 In the event of non-compliance by the customer with what has been agreed with regard to payment, Gold Dry is entitled to terminate the agreement with immediate effect extrajudicially or to suspend its obligations, as well as to allow the customer to access the Gold Dry system without stating reasons. refuse.

Article 4: Delivery / delivery terms

4.1 Deliveries take place exclusively within the Netherlands, unless stated otherwise on the Gold Dry website.
4.2 The delivery time is normally a maximum of five (5) working days, unless stated otherwise on the Gold Dry website. The delivery times are an indication and not a deadline.
4.3 The delivery period of the product is a maximum of thirty (30) working days or shorter than stipulated in the agreement between the customer and Gold Dry.
4.4 When the agreed delivery period is exceeded by Gold Dry for whatever reason, Gold Dry will immediately notify the customer in writing (by letter or e-mail). In that case, the customer has the authority to terminate the agreement with Gold Dry by notifying Gold Dry in writing (by letter or e-mail).
4.5 Any payments already made by the customer in the context of the previous article will be sent to the bank as soon as possible, but in any case within fourteen (14) working days after Gold Dry has received the request for dissolution of the agreement referred to in article 4.4. or giro account of the customer.
4.6 The delivery times stated by Gold Dry will never be regarded as deadlines, unless explicitly agreed otherwise.
4.7 Delivery takes place at the place and time that the goods are ready for shipment to the customer.
4.8 Gold Dry reserves the right to make partial deliveries to the customer, so that an order is sent in two or more shipments.

Article 5: Force majeure and / or special circumstances

5.1 Gold Dry is not obliged to fulfill any obligation towards the customer if it is prevented from doing so as a result of a circumstance that is not due to its fault, nor is it for its account by law, legal act or generally accepted beliefs. .
5.2 Circumstances within the meaning of Article 5.1 include a business failure, a failure in the energy or material supply, transport delay, a strike and the non-delivery or late delivery by suppliers.

Article 6: Retention of title

6.1 All goods delivered to the customer remain the property of Gold Dry, until all amounts owed by the customer for the goods delivered under the agreement have been paid in full to Gold Dry.

Article 7: Risk

7.1 The risk during the transport of the product ordered by the customer is for Gold Dry. At the time of delivery of the product, or the moment that can reasonably be considered as delivery, the risk of the product passes to the customer, except for liabilities that cannot be excluded by law by Gold Dry.

Article 8: Intellectual and industrial property rights

8.1 The customer must fully and unconditionally respect all intellectual and industrial property rights that rest on the goods delivered by Gold Dry.
8.2 Gold Dry does not guarantee that the goods delivered to the customer do not infringe any intellectual and / or industrial property right of third parties and does not accept any liability in the event of any claim from third parties based on the statement that an item delivered by Gold Dry is infringed is made on any right of a third party.

Article 9: Orders / communication

9.1 Gold Dry is in no way liable for misunderstandings, damage, delays or unclear transmission of orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and Gold Dry, or between Gold Dry and third parties, insofar as they relate to the relationship between the customer and Gold Dry.

Article 10: Cooling-off period

10.1 After the customer has received the product ordered by him / her, the customer has the authority to dissolve the underlying agreement with Gold Dry within 14 days after receipt of this product. The customer does not have to give a reason for this.
10.2 If the customer wishes to dissolve the agreement in accordance with article 10.1 of these conditions, the customer must notify Gold Dry of this in writing (by e-mail, letter or fax). The customer must send the product – after consultation with Gold Dry – to a return address determined by Gold Dry. In this case, the customer must bear the costs and risk of shipping himself.
10.3 If the customer has already made some payments at the time when the customer concludes the agreement with Gold Dry pursuant to Article 10.1. and 10.2 of these Purchase Conditions, Gold Dry will refund these payments to the customer within fourteen (14) working days after Gold Dry has received the product returned by the customer.
10.4 Gold Dry reserves the right to refuse returned products or to credit only part of the amount already paid, if it is suspected that the product has already been opened, used or through the fault of the customer (other than that of Gold Dry or the supplier of the product) has been damaged.
10.5 If a product is returned that, in the opinion of Gold Dry, has suffered damage that is attributable to an act or negligence of the customer or is otherwise at the risk of the customer, Gold Dry will notify the customer in writing (via fax, letter or e-mail). Gold Dry has the right to deduct the depreciation of the product as a result of this damage from the amount to be refunded to the customer.

Article 11: Guarantees

There is a guarantee on the products delivered by Gold Dry. This is the warranty as set by the manufacturer on its products. This guarantee does not affect the rights of the customer arising from the law.

Article 12: Complaints

12.1 All complaints in connection with the delivery, quality, quality of the product or any other complaint will be handled seriously by Gold Dry.
12.2 The customer must make a complaint known to Gold Dry’s Support department (the details of this department are stated elsewhere in these Purchase Conditions).
12.3. Gold Dry will try to resolve the complaint within ten (10) working days. Gold Dry will inform the customer about this in writing (by fax, letter or e-mail).

Article 13: Personal data

13.1 Personal data entered by the customer will be included in a file. These data will be used for the execution of the customer’s order.
13.2 Unless the customer has indicated that the customer does not appreciate this, the customer’s data will be included in a central file of Gold Dry. This data will be used to keep the customer fully up-to-date with regard to Gold Dry’s business and services. The processing of the customer’s data will take place in accordance with applicable laws and regulations.
13.3 If desired, the customer can inspect the data that is recorded by Gold Dry about the person of the customer in Gold Dry’s file. The customer is entitled to request changes to the data if these data are incorrect.

Article 15: Miscellaneous

15.1 If the customer provides Gold Dry with an address in writing, Gold Dry is entitled to send all orders to the relevant address, until the customer has given Gold Dry a new address.
15.2 If Gold Dry permits deviations from these Purchase Conditions, tacitly or otherwise, for a short or longer period of time, this does not affect its right to demand immediate and strict compliance with the Purchase Conditions. The customer can never assert any rights on the basis of the fact that Gold Dry applies these Purchase Conditions flexibly.
15.3 Gold Dry is authorized to make use of third parties in the execution of the customer’s order (s).

Article 16: Applicable law and dispute settlement

16.1 Dutch law applies to all offers, orders and agreements of Gold Dry.
16.2 Disputes between Gold Dry and the customer will be submitted to the competent Dutch court in Amsterdam.
